  1. Overview

    THE COMPANY AS A POLICY DOES NOT DISCLOSE ANY CONSUMER OR CUSTOMER NON-PUBLIC INFORMATION TO NON-RELATED THIRD PARTIES OTHER THAN IN CONTROLLED CIRCUMSTANCES AS SPECIFICALLY ALLOWED BY APPLICABLE LAW, INCLUDING, WHERE APPLICABLE, REGULATION S-P.

    Akemona, Inc. and its affiliates (collectively “Akemona”, “we”, “us”, or “our”) operate internationally providing the https://akemona.com website and the Akemona mobile application (hereinafter referred to as the “Service”). Akemona is committed to ensuring that when we collect and use information about visitors to our websites (as described below) we do so in accordance with applicable data privacy laws.

    Akemona provides technology services through the Service. This privacy notice discloses the privacy practices of Akemona and applies solely to the information collected by the Service.

    The Privacy Policy:

    1. provides you information as to how Akemona collects and processes your Personal Data, through the use of the Service and any data you may provide through the Service, and
    2. outlines Akemona’s privacy and transparency practices under applicable law, including, where applicable, the SEC’s Regulation S-P, the California Consumer Privacy Act (“CCPA”), and the General Data Protection Regulation (“GDPR”).

    We respect your privacy and we know that you care how information that you provide is used, stored and shared. Therefore, the use of Personal Data collected through our Service will be limited to purposes stated under this policy.

    This Privacy Policy will inform you about the following:

    1. What personally identifiable information is collected from you through the Service, how it is used and with whom it may be shared.
    2. Your access to and control over personally identifiable information and how you can correct any inaccuracies in the information
    3. Your right to “opt out” of certain sharing of your personal information, where applicable, and the circumstances under which we share information to provide the Service, execute transactions you request, comply with law, and operate our business.
    4. Circumstances where we may be unable to honor a deletion request due to legal, regulatory, security, fraud-prevention, and recordkeeping requirements.
    5. The security procedures in place to protect the misuse of your information.
    6. Use of cookies by our Service

    This page informs you of our policies regarding the collection, use and disclosure of personal data when you use our Service and the choices you have associated with that data. We do not sell your personal information.     By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in Definitions section below.

  2. Definitions

    1. Service: Service means the https://akemona.com website and the Akemona mobile application operated by Akemona, Inc.
    2. Personal Data: Personal Data means data about a living individual who can be identified from those data (or from those and other information either in our possession or likely to come into our possession).
    3. Usage Data: Usage Data is data collected automatically either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

    5. Data Controller: Data Controller means the natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any personal information gets processed.     6. Data Processors (or Service Providers): Data Processor (or Service Provider) means any natural or legal person who processes the data on behalf of the Data Controller. We may use the services of various Service Providers in order to process your data more effectively.
    7. Data Subject (or User): Data Subject is any living individual who is using our Service and is the subject of Personal Data.

    We collect several different types of information for various purposes to provide and improve our Service to you. We collect your personally identifiable data when you use the Akemona website, sign up, engage with features of the Service, or send us an inquiry. Akemona may share this personal information with its business partners and third parties for purposes that are consistent with this Privacy Policy.

    While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you ("Personal Data"). Personally-identifiable information may include, but is not limited to:

    7. Email Address
    8. Public Address of your digital wallet
    9. IP Address
  5. Marketing Communications Preferences

    In compliance with the Akemona Public Communications Policy, we may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or the instructions provided in any email we send.

  6. Tracking & Cookies Data

    We use cookies and similar tracking technologies to track the activity on our Service and we store certain information.

    A cookie is a piece of data stored on a site visitor's hard drive to help us improve your access to our site. A cookie is also used to identify repeat visitors to our site.     We may use and store information about your location ("Location Data"), if you give us permission to do so. We use this data to provide features of our Service, to improve and customize our Service.

    You can enable or disable location services when you use our Service at any time by way of your device settings

    Akemona, Inc. uses the collected data for various purposes:

    3. To allow you to participate in interactive features of our Service when you choose to do so

    5. To gather analysis or valuable information so that we can improve our Service
    6. To monitor the usage of our Service

    8. To protect unauthorized access to customer information
    9. To identify potential intrusion of malicious actors
    10. To protect our network from malware intrusion
    11. To provide you with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information

    Akemona will never ask you for your private key or passwords. Securing your private keys and your passwords is your responsibility.

    Other than what is necessary to fulfill your request and operate the Service, we do not share your information with any third party outside of our organization except as described in this Privacy Policy. Use of your information for operating the Service may include, but is not limited to, login enablement using third parties (such as Google, Facebook and Microsoft), cloud hosting, analytics, customer support, payment processing, escrow services (where applicable), identity verification, regulatory and legal compliance, security, fraud prevention, and the development and improvement of our products, services, content and advertising.

    As part of compliance with applicable legal and compliance requirements, the information that you provide may be used for validation against sanctions, anti-money laundering, or fraud-prevention databases, as applicable.

    Transactions that you execute on a public blockchain through the Service may be publicly available using your public address. You may need to provide the public address of your digital wallet to us in order for us to provide certain Service features.

    Unless you ask us not to, we may contact you via email in the future to tell you about our products or services, or changes to this privacy policy.

  10. Your Access to And Control Over Your Personally Identifiable Information

    By changing your preferences on the Akemona website, you can do the following at any time:

    1. See what data we have about you, if any.
    2. Correct any data we have about you.
    3. We may be unable to honor requests to delete certain data because we must retain certain records for legal, regulatory, security, fraud-prevention, and recordkeeping purposes, including to maintain transaction and compliance records.
    4. Express any concern you have about our use of your data.

    Also, you may opt out of any future contact from us at any time.

  11. Your Requests for Opting Out and Deletion of Your Personal Data

    We do not share your personal information with third parties for their direct marketing. We may send you newsletters, information about website upgrades and new products through emails. You can opt out of these communications by clicking on the unsubscribe link at the bottom of these communications.

    We may be unable to comply with certain requests to delete your personal data due to legal, regulatory, security, fraud-prevention, dispute resolution, and business operations-related restrictions, including where we must retain records of transactions and related compliance activity.

  12. Refusal to Provide Necessary Personal Data

    We require your Personal Data:

    1. to provide the products and services contracted by you or your organization
    2. to further a professional relationship, venture, or other collaboration, or
    3. to comply with applicable law or regulation.

    Where you fail to provide that data when requested, we may not be able to provide our products and/or services to you or your organization or to collaborate with you or your organization.

  13. Security Procedures in Place to Protect the Misuse of Your Information

    Wherever we collect sensitive information (such as date of birth), that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a lock icon in the address bar and by looking for "https" at the beginning of the address of the Web page.

    While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job are granted access to personally-identifiable information. The computers/servers, in which we store personally- identifiable information, are kept in a secure environment behind a firewall.

  14. Legal Basis for Processing Personal Data under the GDPR

    If you are from the European Economic Area (EEA), Akemona’s legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it.

    Akemona, Inc. may process your Personal Data because:

    1. We need to perform a contract with you
    2. You have given us permission to do so
    3. The processing is in our legitimate interests and it is not overridden by your rights
    4. For payment processing purposes
    5. To comply with the law
  15. Retention of Data

    Akemona, Inc. will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use certain Personal Data and related records for a minimum of 6 years (or such other period as required or permitted by applicable law) to comply with legal and compliance obligations, resolve disputes, and enforce our legal agreements and policies.

    Akemona, Inc. will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or when we are legally obligated to retain this data for longer periods.

  16. Transfer of Data

    Your information, including Personal Data, may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

    If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to the United States and process it there.

    Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

    Akemona, Inc. will take all reasonably necessary steps to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

  17. Disclosure of Data

    Under certain circumstances, Akemona, Inc. may be required to disclose your Personal Data:

    1. Business Transaction: If Akemona, Inc. is involved in a merger, acquisition or asset sale, your Personal Data may be transferred. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.
    2. Disclosure to Law Enforcement: if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency).
    3. Disclosure for Legal Reasons:

      Akemona, Inc. may disclose your Personal Data in the good faith that such action is necessary to:

      1. Comply with a legal obligation
      2. Protect and defend the rights or property of Akemona, Inc.
      3. Prevent or investigate possible wrongdoing in connection with the Service
      4. Protect the personal safety of users of the Service or the public
      5. Protect against legal liability
    4. Service Providers: We may employ third party companies and individuals ("Service Providers") to facilitate our Service. These provide the Service on our behalf, perform Service-related services or assist us in analyzing how our Service is used. These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose. These service providers include, but are not limited to the cloud platform that hosts Akemona’s technology infrastructure, identity verification vendors (as applicable), payment processing vendors, escrow services agencies (where applicable), and customer support services. In addition, Akemona uses public blockchains such as Ethereum, which may allow third parties to view token balances and transactions using public wallet addresses.
    5. Professional Advisors: We may share your Personal Data with our auditors, lawyers or other professional advisors so they can support our business. Like the other service providers, these professional advisors are bound by contractual obligations to keep Personal Data confidential and use it only for the purposes for which we disclose it to them
  18. Security of Data

    We have reasonable and appropriate security measures (including technical and organizational measures) in place to protect against the loss, misuse, and alteration of any Personal Information we receive about you. However, there is no guarantee, and we cannot guarantee, that information will not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. When you submit information to us, you should be aware that your information is transmitted across the Internet and that no method of transmission over the Internet is completely or 100% secure.

  19. California Online Protection Act (CalOPPA)

    Do Not Track

    We do not support Do Not Track ("DNT"). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked.

    You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.
